In all the outrage about China blocking the UN designation of Jaish-e-Mohammed (JeM) chief Masood Azhar under Security Council Resolution 1267 there’s one question noone is asking Pakistan — not India not the US not Pakistanis: Why has Pakistan not arrested Masood Azhar yet under its own anti-terrorism law Pakistan already has a strong legal regime in place against the likes of Azhar that gives the government enough powers against those designated by its own law as terrorists or members of such groups designated as terrorist Designation under UNSC Resolution 1267 does not explicitly require a government to arrest the designated individual although it demands an arms embargo a funds freeze and a travel ban The 1999 resolution was aimed at the Taliban regime in Afghanistan and their protection to Osama bin Laden Demanding that the Taliban “turn over Usama bin Laden without further delay to appropriate authorities in a country where he has been indicted” it asks all states to “deny permission for any aircraft… owned leased or operated on behalf of the Taliban”; and a freeze on funds and other financial resources including funds from property directly or indirectly owned or controlled by the Taliban Over the years the UNSC added several other resolutions to the 1267 regime including Resolution 1390 in 2002 which demands that “States shall take the following measures with respect to Usama bin Laden members of the Al-Qaida organisation and the Taliban and other [designated] individuals groups undertakings and entities associated with them”: Freeze funds controlled directly or indirectly by such persons and ensure no one else makes any financial resources available to them; prevent the entry into or the transit through their territories of these individuals; put in place an arms embargo This could be interpreted as demanding that such groups be proscribed in the country where they exist or operate and such individuals be put behind bars Pakistan has already done the first: In 2002 it banned the JeM as a terrorist group under the country’s 1997 Anti-Terrorism Act (ATA) Under the provisions of this act Azhar can be arrested for being a member of the group and if convicted can be senten-ced to up to five years in prison So long as Pakistan claimed it did not know where Azhar was it could duck acting against him under the ATA But no less a person than the country’s de facto foreign minister Sartaj Aziz has now acknowledged that Azhar is in the protective custody of the Pakistan government India should be mounting pressure on Pakistan — and getting other interested countries to do the same — to arrest Azhar immediately under the ATA for belonging to a group that is designated under its own laws This in fact may be a better course of action than asking Pakistan to act against Azhar as the mastermind behind the Pathankot attack Getting the JeM designated as an international terrorist group and Azhar an international terrorist under 1267 would be a diplomatic victory for India but going by what Pakistan did — or did not do — after the Jamat-ud-Dawa (JuD) and Hafiz Saeed were designated as terrorists in 2008 it’s not going to yield results on the ground After 60 years it should be a no-brainer that Pakistan is not going to act against someone as high up in the terrorist hierarchy as Azhar on its territory just because India says he is behind a terrorist attack on Indian soil even if it gets the world’s backing on it To recap what happened after Hafiz Saeed was designated in 2008 under 1267: Pakistan placed him under house arrest under its Maintenance of Public Order Act and when he contested the arrest the government pleaded in court that there was a UN ban on him When the court found there was no arrest clause in the UN designation it swiftly ended his detention Pakistan has time and again taken the plea that it cannot act against Saeed because it has to act according to the country’s laws It takes much pride in projecting itself as a country bound by the “rule of law” and in the independence of its courts How many times has it told India that the trial in the Mumbai case in its courts was not being deliberately delayed but that this was how Pakistan’s courts and laws worked Here then is a law that Pakistan already has which can be deployed against Azhar not because there is an arrest warrant out for him in India but because he is a member of a group designated as terrorist by Pakistan Second Pakistan has made the case many times especially when accused by India of sheltering terrorists that it has been one of the worst victims of terrorism and therefore it has no incentive to harbour terrorists New Delhi should be using this argument to make the case that Pakistan must arrest Azhar in its own interests not for India but because terrorism has claimed thousands of Pakistani lives Evidence of the JeM’s involvement in Pathankot is not necessary for Pakistan to arrest Azhar Nor is there any need for an Indian investigation team to visit Pakistan just as there was no need except a diplomatic point-scoring one from India’s point of view for a Pakistani team to visit Pathankot Under the ATA a person is guilty of an offence if he is a member of a banned group addresses a meeting of the banned group promotes the group or encourages support for it or raises funds for it The JeM is a banned group in Pakistan The JeM and its known proxies and “trusts” of the group are in a list of 72 organisations submitted to the Senate Pakistan’s Upper House of parliament in December 2015 The list included the JeM as a group banned by Pakistan Those “enlisted” under UNSC 1267 like the JuD were listed separately The act prescribes punishment ranging from imprisonment of six months to five years for these offences For years after India released Azhar in exchange for the passengers on the hijacked IC 814 Pakistan pretended it did not know where he was He was briefly arrested after the JeM was banned in 2002 then let off To India’s queries as to his whereabouts Pakistan always responded that it did not know where he was Azhar too kept a low profile although it was widely believed that he lived in Bahawalpur in Pakistan’s Punjab province Pakistan can no longer say it does not know where he is He is right there in the “protective custody” of the Pakistani authorities They can arrest him under the ATA without any evidence from India In recent days many sections of Pakistan’s vibrant civil society and media have lauded the Pakistan army’s resolve to tackle terrorism and its decision to “clean” Punjab province of terrorists in the wake of the Lahore Easter attack that killed 70 people According to some reports the operations have already begun They should be demanding that the army wind down all groups identified as terrorist under Pakistan’s laws including the JeM headquartered in Bahawalpur southern Punjab (This article first appeared in the print edition under
